The effective date of these terms is 05/05/2021, and the validity of all previous versions expires when a new version is published. Below you can read how we process your data, where we store data, which security measures we use and for whom the data are visible

E-commerce software

Our webshop is developed with software from Shopify. Personal data that you make available to us for the purpose of our services is shared with this party. Shopify has access to your data to provide us with technical support and will never use the data for any other purpose. Based on the agreement we have concluded with them, Shopify is obliged to take appropriate security measures. These security measures include the use of SSL encryption and a strong password policy. Shopify is a certified processor of credit card data. Shopify uses cookies to collect technical information regarding the use of the software; no personal data is collected and/or stored. Shopify reserves the right to share collected data within its own group to further improve the service. Shopify takes into account the applicable legal retention periods for (personal) data. The EU/US Privacy Shield applies, and your data may be processed within the United States.

Web hosting

We use web hosting and email services from Shopify. Shopify processes personal data on our behalf and does not use your data for its own purposes. However, this party can collect metadata about the use of the services. This is not personal data. Shopify has taken appropriate technical and organizational measures to prevent the loss and unauthorized use of your personal data. Shopify is obliged to maintain confidentiality based on the agreement.

Email and mailing lists

Our website uses Klaviyo, a third-party service that handles email traffic from our website and sends any newsletters. All confirmation emails you receive from our website and web forms are sent via Klaviyo's servers. Klaviyo will never use your name and email address for its own purposes. At the bottom of every email sent automatically through our website, you will see the "unsubscribe" link. If you click on this, you will no longer receive any emails from our website. This may severely impact the functionality of our website! Your personal data is securely stored by Klaviyo. Klaviyo uses cookies and other internet technologies to track whether emails are opened and read. Klaviyo reserves the right to use your data to further improve the service and share information with third parties in that regard.

For our regular business email traffic, we use the services of Gmail. This party has taken appropriate technical and organizational measures to prevent misuse, loss, and corruption of your and our data as much as possible. Gmail does not have access to our mailbox, and we treat all our email traffic confidentially.

payment processors

To handle (part of) the payments in our webshop, we use the platform of Mollie. Mollie processes your name, address, and place of residence, as well as your payment details such as bank account or credit card number. Mollie has taken appropriate technical and organizational measures to protect your personal data. Mollie reserves the right to use your data to further improve their services and share (anonymized) data with third parties for that purpose. All the safeguards mentioned above regarding the protection of your personal data also apply to the parts of Mollie's services for which they engage third parties. Mollie does not retain your data longer than allowed by law.

For handling (part of) the payments in our webshop, we use the platform of Klarna. Klarna processes your name, address, and place of residence, as well as payment details such as bank account or credit card number. Klarna has taken appropriate technical and organizational measures to protect your personal data. Klarna reserves the right to use your data to further improve their services and share (anonymized) data with third parties for that purpose. In case of an application for deferred payment (credit facility), Klarna shares personal data and information regarding your financial position with credit rating agencies. All the safeguards mentioned above regarding the protection of your personal data also apply to the parts of Klarna's services for which they engage third parties. Klarna does not retain your data longer than allowed by law.

Shipping and logistics

When you place an order with us, it is our responsibility to have the package delivered to you. We do not use courier services and deliver all watches ourselves, personally.

Billing and accounting

For keeping our administration and accounting records, we use the services of Cijfermeester. We share your name, address, and place of residence data, as well as details related to your order. This data is used for the administration of sales invoices. Your personal data is sent and stored securely. Cijfermeester is obligated to maintain confidentiality and will treat your data confidentially. Cijfermeester will not use your personal data for any other purposes than those described above.

Purpose of data processing

We only use your data for the purpose of providing our services. This means that the purpose of processing is always directly related to the assignment you have given us. We do not use your data for (targeted) marketing. If you share your data with us, and we use this data to contact you at a later time - other than at your request - we will explicitly ask for your permission. Your data will not be shared with third parties, except to comply with accounting and other administrative obligations. These third parties are all bound to confidentiality based on the agreement between them and Lifetime Watches, an oath or a legal obligation. Automatically collected data through our website is processed with the aim of further improving our service. This data (such as IP address, web browser and operating system) is not personal data.

Cooperation in tax and criminal investigations

In certain cases, LifeTime Watches may be required by law to share your data in connection with fiscal or criminal investigations carried out by the government. In such a case, we will be obliged to share your data, but we will resist to the extent permitted by law.

Retention periods

We will retain your data for as long as you are a client of ours. This means that we will keep your client profile until you indicate that you no longer wish to use our services. If you request for your profile to be removed, we will delete your profile. In accordance with applicable administrative obligations, we are required to keep invoices containing your (personal) data for the applicable term. We will therefore keep this data for as long as the relevant term applies. However, employees will no longer have access to your client profile and documents that we have produced in response to your request.

Your rights

Under applicable Dutch and European legislation, you as a data subject have certain rights with respect to the personal data processed by or on behalf of us. We explain below what these rights are and how you can exercise them. In principle, to prevent abuse, we send copies and copies of your data only to the email address known to us. If you wish to receive the data at a different email address or by post, for example, we will ask you to identify yourself. If your request is granted, we will send it to the email address known to us, with a confirmation that the data has been adjusted.

Right to restriction of processing

You always have the right to restrict the processing of data that we (or third parties acting on our behalf) process which relate to you as an individual or can be traced back to you. You can make a request to that effect to our contact person for privacy matters. You will receive a response to your request within 30 days. If your request is granted, we will send a confirmation to the email address we have on file, stating that the data processing has been restricted and will no longer take place.

Right to data portability

You always have the right to have the data that we (or third parties acting on our behalf) process which relate to you as an individual or can be traced back to you, transferred to another party. You can make a request to that effect to our contact person for privacy matters. You will receive a response to your request within 30 days. If your request is granted, we will send copies or duplicates of all the data we have processed, or that have been processed on our behalf by other processors or third parties, to the email address we have on file. However, in all likelihood, we will no longer be able to continue providing services in such a case, as the secure link of data files can no longer be guaranteed.

Right of object and other rights

In certain cases, you have the right to object to the processing of your personal data by or on behalf of LifeTime Watches. If you object, we will immediately stop processing the data while awaiting the handling of your objection. If your objection is well founded, we will provide you with copies and/or copies of the data that we process or have processed on your behalf and permanently stop this data being processed.
