This privacy policy applies to the use of the website and the services provided through it by LifeTime Watches. The effective date for the validity of these terms is 05/05/2021; with the publication of a new version, the validity of all previous versions ceases. Online store software

Our web store is developed with software from Shopify. Personal data that you provide to us for the purpose of our services will be shared with this party. Shopify has access to your data to provide us with (technical) support; they will never use the data for any other purpose. Shopify is obligated, based on the agreement we have with them, to take appropriate security measures. These security measures consist of the application of SSL encryption and a strong password policy. Shopify is a certified processor of credit card data. Shopify uses cookies to collect technical information regarding the use of the software; no personal data is collected and/or stored. Shopify reserves the right to share collected data within its own organization to further improve the service. Shopify takes into account the applicable legal retention periods for (personal) data. The EU/US Privacy Shield applies; your data may be processed in the United States.

Web hosting

'We obtain web hosting and email services from Shopify. Shopify processes personal data on our behalf and does not use your data for its own purposes. However, this party may collect metadata about the use of the services. This does not constitute personal data. Shopify has taken appropriate technical and organizational measures to prevent loss and unauthorized use of your personal data. Shopify is obligated to confidentiality under the agreement.'

Email and mailing lists

Our website uses Klaviyo, a third party that handles the email traffic coming from our website and the sending of any newsletters. All confirmation emails you receive from our website and web forms are sent via Klaviyo's servers. Klaviyo will never use your name and email address for its own purposes. At the bottom of every email that is automatically sent via our website, you will see the 'unsubscribe' link. If you click on this, you will no longer receive emails from our website. This may severely reduce the functionality of our website! Your personal data is securely stored by Klaviyo. Klaviyo uses cookies and other internet technologies to provide insight into whether emails are opened and read. Klaviyo reserves the right to use your data to further improve the service and, in this context, share information with third parties.

'We use the services of Gmail for our regular business email communication. This party has taken appropriate technical and organizational measures to prevent abuse, loss, and corruption of your and our data as much as possible. Gmail does not have access to our inbox, and we treat all our email communication confidentially.' 

Payment processors

To handle (part of) the payments in our web store, we use the platform of Mollie. Mollie processes your name, address, and residence details, as well as your payment information such as bank account or credit card number. Mollie has taken appropriate technical and organizational measures to protect your personal data. Mollie reserves the right to use your data to further improve the service and, in this context, share (anonymized) data with third parties. All the aforementioned safeguards regarding the protection of your personal data also apply to the parts of Mollie's services for which they engage third parties. Mollie does not retain your data longer than permitted by legal terms.

Klarna processes your name, address, and residence information, as well as payment details such as bank account or credit card number. Shipping and logistics

'When you place an order with us, it is our responsibility to deliver your package to you. We do not use parcel services and personally deliver all watches ourselves.' 

Invoicing and accounting

"For maintaining our administration and accounting, we use the services of Cijfermeester. We share your name, address, and residence details, as well as information regarding your order. This data is used for administering sales invoices. Your personal data is sent and stored securely. Cijfermeester is obligated to confidentiality and will treat your data confidentially. Cijfermeester does not use your personal data for any purposes other than those described above." 

Purpose of data processing

We use your data solely for the purpose of our services. This means that the purpose of the processing is always directly related to the assignment you provide. We do not use your data for (targeted) marketing. If you share your data with us and we use this data to contact you at a later time - other than at your request - we explicitly ask for your consent. Your data will not be shared with third parties, except to comply with accounting and other administrative obligations. These third parties are all bound to confidentiality based on the agreement between them and us or an oath or legal obligation. Automatically collected data by our website is processed with the aim of further improving our services. This data (for example, IP address, web browser, and operating system) is not personal data.

Cooperation in tax and criminal investigations

In certain cases, LifeTime Watches may be required by law to share your data in connection with fiscal or criminal investigations by government authorities. In such cases, we are compelled to share your data, but we will resist this to the extent permitted by law.

Retention periods

"We will retain your data as long as you are our client. This means that we will keep your customer profile until you indicate that you no longer wish to use our services. If you inform us of this, we will also interpret it as a request for deletion. Based on applicable administrative obligations, we are required to keep invoices with your (personal) data, so we will retain this data for as long as the applicable period lasts. However, employees no longer have access to your client profile and documents that we have created as a result of your assignment."

Your rights

Under applicable Dutch and European legislation, you as a data subject have certain rights regarding the personal data that is processed by or on behalf of us. We explain below what these rights are and how you can invoke them. In principle, to prevent misuse, we only send copies and extracts of your data to the email address known to us that you provided. In the event that you wish to receive the data at a different email address or, for example, by post, we will ask you to verify your identity. We maintain a record of processed requests; in the case of a request for erasure, we administer anonymized data. You will receive all copies and extracts of data in the machine-readable data format that we use within our systems. You have the right at any time to file a complaint with the Dutch Data Protection Authority if you suspect that we are using your personal data in an incorrect manner.
 

Right of inspection 

You always have the right to access the data that we (have) processed and that relate to you as a person or can be traced back to you. You can make a request to this effect to our contact person for privacy matters. You will receive a response to your request within 30 days. If your request is granted, we will send it to the email address known to us, and we will then send a copy of all data along with an overview of the processors that hold this data, indicating the category under which we have stored this data. 

Right of rectification 

You always have the right to have the data that we (have) processed and that relate to you as a person or can be traced back to you, adjusted. You can make a request to this effect to our contact person for privacy matters. You will receive a response to your request within 30 days. If your request is granted, we will send this to the email address known to us, with a confirmation that the data has been adjusted. 

Right to restriction of processing

You always have the right to restrict the processing of data that we (have) processed that relates to your person or can be traced back to you. You can make a request to that effect to our contact person for privacy matters. You will receive a response to your request within 30 days. If your request is granted, we will send this to the email address known to us, along with a confirmation that the data restriction has been completed and that it is no longer being processed. 

Right to portability

You always have the right to have the data that we (have) processed and that relates to you as a person or can be traced back to you, carried out by another party. You can make a request to that effect to our contact person for privacy matters. You will receive a response to your request within 30 days. If your request is granted, we will send this to the email address known to us with copies or duplicates of all the data we have processed or that has been processed on our behalf by other processors or third parties. In such a case, we will likely no longer be able to continue the service, as the secure connection of data files can no longer be guaranteed. 

Right to object and other rights

You have the right to object to the processing of your personal data by or on behalf of LifeTime Watches in certain cases. If you object, we will immediately cease the data processing pending the resolution of your objection. If your objection is justified, we will provide you with copies and/or excerpts of data that we process (or have processed) and then permanently cease the processing. You also have the right not to be subjected to automated individual decision-making or profiling. We do not process your data in such a way that this right applies. If you believe this is the case, please contact our privacy officer. 

Cookies

Cookies are placed by the American company Google via our website as part of the "Analytics" service. We use this service to track and report on how visitors use the website. This processor may be required to provide access to this data under applicable laws and regulations. We collect information about your browsing behavior and share this data with Google. Google may interpret this information in conjunction with other datasets and thereby track your movements on the internet. Google uses this information for offering targeted advertisements (Adwords) and other Google services and products.
